These Terms of Service (the “Terms”) govern your access to and use of the VisitBariOfficial marketplace (the “Site” or “Platform”), operated by Visit Bari srl. By browsing the Site, registering an account, publishing a listing or sending a contact request, you accept these Terms in full. If you do not agree with any part of them, please do not use the Site. These Terms apply to both guests who look for a place to stay and owners who list a property.
1. Definitions
- “Platform” / “Site” means the VisitBariOfficial online marketplace accessible at the published domain.
- “Owner” means a registered user who publishes one or more listings of a property located in Bari.
- “Guest” means any visitor who browses listings or sends a contact request to an owner.
- “Listing” means the set of information, photographs and availability data published by an owner for a single property.
- “Booking” means any agreement, whether written or oral, concluded directly between a guest and an owner for the short-term rental of a property.
- “CIN” means the Italian national identification code required by law for tourist rentals.
2. Our role
Visit Bari Official is an independent online marketplace that lists vacation homes and apartments located in the city of Bari, Italy. We are a showcase, not an online travel agency and not a real-estate broker. We are not a party to any booking agreement between a guest and an owner. We do not collect guest payments, we do not guarantee the availability or the quality of any property, we do not mediate disputes between users and we do not provide any warranty regarding the accuracy of the information published in listings. All interactions and transactions occur directly between users.
3. Free service
The Platform is completely free for owners. Publishing a listing, keeping it visible and using all the features of the Site entail no cost, no subscription and no commission, for an unlimited duration. Visit Bari Official does not collect any fee from owners or from guests. We reserve the right to introduce paid features in the future, but any such change will be communicated in advance and will never apply retroactively to listings already published.
4. Eligibility and registration
To register as an owner you must be at least 18 years old and have the legal capacity to enter into binding contracts under Italian law. Registration is free. You must provide accurate, complete and up-to-date information and keep it updated. You are responsible for safeguarding your password and for all activity carried out from your account. You may not transfer or share your account with third parties. We may suspend or close accounts that provide false information or that are used in breach of these Terms.
5. Direct booking and payments
All bookings happen directly between you and the property owner. Visit Bari Official does not process guest payments and is not involved in the financial transaction. You are solely responsible for agreeing with the other party on dates, price, payment method, cancellation conditions and any other term of the rental. Always verify the listing and the identity of the owner before sending any payment. We strongly recommend using traceable payment methods and obtaining written confirmation of the agreed terms.
6. Owner obligations
- Provide accurate descriptions, real and recent photographs, a valid address within the municipal territory of Bari and a valid CIN code.
- Hold all necessary rights, licences and consents to publish the listing content, including photographs.
- Keep the availability calendar up to date, including via iCal synchronisation where used.
- Honour confirmed bookings and clearly communicate the cancellation conditions to the guest.
- Comply with all applicable laws and regulations on short-term rentals, including tax, safety, hygiene and guest-registration obligations.
- Keep 100% of the agreed price and be solely responsible for their own taxes, insurance and contractual obligations towards guests.
- Respond to guest enquiries promptly and in good faith.
7. Guest obligations
- Provide truthful information when sending a contact request.
- Use the Site only for lawful purposes and in good faith.
- Respect the property, the house rules communicated by the owner and the local regulations of Bari.
- Pay the owner as agreed and not engage in fraud or payment abuse.
- Not misuse owner contact details for purposes other than arranging a booking (for example, no unsolicited marketing).
Visit Bari Official is not liable for the conduct of owners or guests and does not verify the identity of users beyond the technical registration process.
8. Listings and content moderation
Owners are solely responsible for the content of their listings. We may, at our discretion and without notice, review, edit, hide or remove any listing that is inaccurate, misleading, unlawful, duplicated or in breach of these Terms. We may also refuse to publish a listing that does not pass our automated or manual review process. The publication of a listing does not constitute an endorsement by Visit Bari Official. We act as a hosting provider for user-generated content and, in accordance with applicable law, we will promptly remove unlawful content upon receiving a valid notice sent to info@visitbariofficial.com.
9. Geographic restriction
The Platform is dedicated exclusively to properties located within the municipal territory of the city of Bari, Italy. Listings whose address or geographic coordinates fall outside the boundaries defined by the Platform will be rejected or removed. This restriction is intended to maintain the focus and the quality of the marketplace.
10. Calendar synchronisation (iCal)
Owners may connect external iCal calendars (for example, from Booking.com or Airbnb) to keep availability up to date. Synchronisation is automated at the intervals supported by the Platform and may be subject to delays or limitations imposed by the third-party services. The owner remains responsible for the accuracy of the availability calendar and for preventing double bookings. Visit Bari Official is not liable for overbookings, sync failures or for any damage resulting from reliance on synchronised data.
11. Prohibited conduct
You agree not to:
- Publish false, misleading or fraudulent listings, or listings for properties not actually available.
- Impersonate another person or entity, or misrepresent your affiliation.
- Collect or harvest contact details of other users for unsolicited communications.
- Attempt to gain unauthorised access to the Platform, its systems or other users' data.
- Introduce viruses, malware or any code that could damage or interfere with the Platform.
- Use automated tools (bots, scrapers) to extract data without our prior written consent.
- Circumvent the direct-contact model by inserting external booking links or by charging platform-style fees.
- Use the Site for any unlawful, discriminatory or harmful purpose.
12. Intellectual property
The Platform, its design, logos, texts and source code are the property of Visit Bari srl and are protected by applicable intellectual-property laws. Owners retain the rights to the content of their listings (photographs, descriptions) and grant the Platform a non-exclusive, royalty-free licence to display that content for the purpose of operating the marketplace. You may not reproduce, copy or exploit any part of the Platform without our prior written consent.
13. Disclaimers
The Platform is provided on an “as is” and “as available” basis. To the fullest extent permitted by law, Visit Bari Official disclaims all warranties, express or implied, regarding the Platform, including warranties of merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the Platform will be uninterrupted, error-free or secure, or that any listing is accurate, complete or up to date. Any reliance on listing content is at your own risk.
14. Limitation of liability
To the extent permitted by applicable law, in no event shall Visit Bari srl, its directors, employees or partners be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, data, bookings or goodwill, arising out of or in connection with your use of the Platform or with any booking or interaction between users, even if advised of the possibility of such damages. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law.
15. Indemnification
You agree to indemnify and hold harmless Visit Bari srl, its directors, employees and partners from any claim, demand, loss, damage or expense (including reasonable legal fees) arising out of your breach of these Terms, your misuse of the Platform, your violation of any law or the rights of a third party, or arising out of any listing content you publish.
16. Account suspension and termination
We may suspend or terminate your access to the Platform at any time, with or without notice, if we reasonably believe that you have breached these Terms, that your conduct is harmful to the Platform or to other users, or in order to comply with a legal obligation. You may close your account at any time from your dashboard. Upon termination, your listings will be removed. The provisions of these Terms that by their nature should survive termination shall remain in effect.
17. Governing law and jurisdiction
These Terms are governed by Italian law. Any dispute arising out of or in connection with these Terms or with the use of the Platform shall, failing amicable settlement, be submitted to the exclusive jurisdiction of the courts of Bari, Italy. As a consumer, you retain the right to bring proceedings in the courts of the Member State in which you reside, where applicable law so provides.
18. Alternative dispute resolution
In accordance with applicable consumer law, we inform you that, for disputes concerning contractual obligations arising from the use of the Platform, the European Commission provides an online dispute-resolution platform accessible at https://ec.europa.eu/consumers/odr. Before initiating any legal proceedings, we encourage you to contact us at info@visitbariofficial.com to seek an amicable solution.
19. Changes to these Terms
We may update these Terms from time to time. The “last updated” date at the top of this page indicates the latest version. We will notify owners of material changes by email or through a notice on the Platform. Continued use of the Platform after the effective date of the updated Terms constitutes acceptance of the revised Terms.
